Have you already made an invention? These are the next steps:
1. Complete the invention disclosure form and send it to the MHH Legal Department (OE 0400). You can download the invention disclosure form here: : Notification of Invention
ATTENTION: Invention disclosures must be made before the scientific publication, as a patent application is no longer possible after publication.
2. As soon as the invention has been received by the legal department, you will receive feedback and a copy of the invention disclosure will be forwarded to Ascenion for review.
3. Ascenion evaluates the invention with regard to patentability and the prospect of commercial utilisation and makes a recommendation to the legal department as to whether MHH should claim the invention. Ascenion is in close contact with you as the inventor for the evaluation.
4a. If the MHH approves your invention, you can apply for a patent at your own expense and MHH has no rights to it.
4b. If MHH claims your invention, the application process will be started in co-operation with an external patent attorney. MHH will bear the application costs. The invention is protected from the time of application (retroactively if the patent is granted).
5. Once the patent application has been filed, Ascenion takes care of its commercialization, e.g. by licensing it to companies, agreeing an industrial cooperation or within a spin-off from the MHH.
Important: All information in connection with an invention will be treated as strictly confidential by all parties involved.
If you have any questions on the subject of invention disclosures or need help, please contact us! We will be happy to help you.

- In many cases, a patent is an important prerequisite for commercializing an invention. A patent gives the patent holder a competitive edge over competitors for a period of up to 20 years. By commercializing and subsequently putting an invention on the market, it will ultimately also be of benefit to the patients.
- If the MHH has claimed an invention, then it will assume responsibility for the full cost of the application and maintenance process. If the patent is exploited, the inventor is entitled to 30% of any gross revenue.
- If the inventor wants to exploit the patent in the form of a startup, this is taken into account and a fair agreement with the founders will be reached.
- Inventors are entitled to receive 30% of any gross revenue generated on the basis of a patent.
- In accordance with the German Employee Inventions Act, MHH employees are obliged to inform MHH’s Legal Department (OE 0400) of their inventions in writing. Forms: Notification of Invention
- The MHH as the responsible institution is required to evaluate whether an invention was made in connection with the employee’s official job responsibilities or know-how.
- If the invention is job-related, the MHH itself may become the owner of the property rights and contractual partner of the respective licensee by claiming the invention.
